By installing or using Backup Samurai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not install or use the Service. These Terms apply to all users of the Service.
Backup Samurai is a Shopify application that provides automated backup and restore functionality for Shopify stores. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice.
We will make reasonable efforts to maintain service availability but do not guarantee uninterrupted access. Scheduled maintenance may cause brief periods of unavailability.
To use Backup Samurai, you must have a valid Shopify merchant account. You are responsible for:

Paid plans are billed through Shopify's built-in billing system. By subscribing to a paid plan, you authorise Shopify to charge your account on a recurring basis according to the plan you select.
Free trial: All paid plans include a 7-day free trial. You will not be charged until the trial ends. Cancel anytime during the trial at no cost.
Annual billing: Annual plans are billed upfront for 12 months at a 20% discount versus the monthly rate. Refunds for unused months are governed by Shopify's billing policies.
Plan changes: Upgrades take effect immediately and you are billed the prorated difference. Downgrades take effect at the next billing cycle.
We reserve the right to change pricing with 30 days' notice. Price changes do not apply to active annual subscriptions until renewal.
You retain full ownership of all data backed up through the Service. By using the Service, you grant us a limited, non-exclusive licence to access, copy, and store your store data solely for the purpose of providing backup and restore functionality.
We will handle your data in accordance with our Privacy Policy.
Backup accuracy: While we strive to create complete and accurate backups, we cannot guarantee that all data will be captured in every backup. You should not rely on Backup Samurai as your sole means of data protection.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be error-free, uninterrupted, or that backups will be complete or accurate in all cases.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BACKUP SAMURAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
You may cancel your subscription and uninstall the Service at any time through your Shopify admin. Cancellation takes effect at the end of your current billing period (or immediately for free plan users).
We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or for other legitimate operational reasons, with notice where reasonably practicable.
Upon termination, we will delete your backup data in accordance with our Privacy Policy.
These Terms are governed by applicable law. Any disputes will be resolved through binding arbitration or the courts of competent jurisdiction as required.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
